2、全縣農資經營戶和生產企業基本情況。截止目前,該(gai)縣共(gong)有(you)(you)農(nong)資商(shang)品經(jing)營(ying)單位和個(ge)人共(gong)有(you)(you)177家,其中(zhong)化(hua)肥經(jing)營(ying)戶(hu)46家,農(nong)藥經(jing)營(ying)戶(hu)73家,獸(shou)藥經(jing)營(ying)戶(hu)22家,種(zhong)子(zi)經(jing)營(ying)戶(hu)36家(只有(you)(you)縣種(zhong)子(zi)公(gong)司有(you)(you)種(zhong)子(zi)經(jing)營(ying)許可證)。
二、迫切需要解決的問題
通過全(quan)面(mian)調查了解可以看出(chu),近幾年來,經過各方共同努(nu)力(li),在(zai)監(jian)督管理(li)與(yu)(yu)專項(xiang)整(zheng)治相結合(he)、教育與(yu)(yu)服務相結合(he)等(deng)措施督促下,全(quan)縣農資市場(chang)總體形勢是好的,但全(quan)面(mian)分析,還存在(zai)著一些不容忽視的問題:
1、對農資市場管理工作認識不到位,重視不夠。一是部(bu)分領導干部(bu)對農(nong)資(zi)(zi)(zi)市場管(guan)理(li)(li)(li)的(de)戰略(lve)性、重(zhong)要(yao)性、全(quan)局性認識不足,對培育(yu)、發展、規范農(nong)資(zi)(zi)(zi)市場重(zhong)視不夠。片面(mian)地認為農(nong)資(zi)(zi)(zi)市場管(guan)理(li)(li)(li)是職(zhi)能(neng)部(bu)門(men)的(de)事與政府沒(mei)有關系,造成(cheng)(cheng)農(nong)資(zi)(zi)(zi)市場的(de)管(guan)理(li)(li)(li)沒(mei)有形成(cheng)(cheng)合(he)力。二是農(nong)資(zi)(zi)(zi)市場缺(que)乏有效(xiao)管(guan)理(li)(li)(li),農(nong)資(zi)(zi)(zi)經營戶(hu)各(ge)自為政,呈現出一盤散沙狀態。造成(cheng)(cheng)農(nong)資(zi)(zi)(zi)產品進(jin)貨渠道(dao)混亂(luan),品牌(pai)雜亂(luan),有的(de)產品標(biao)(biao)簽標(biao)(biao)識不全(quan),化(hua)肥(fei)有效(xiao)成(cheng)(cheng)份不足,甚至以假(jia)充真、以次充好等,擾亂(luan)了農(nong)資(zi)(zi)(zi)市場秩(zhi)序,使管(guan)理(li)(li)(li)難度加大,同時(shi)一些小商小販走村(cun)串戶(hu)銷售農(nong)資(zi)(zi)(zi)現象時(shi)有發生,給制假(jia)、販假(jia)、售假(jia)提供了可乘(cheng)之機。特別是今年農(nong)資(zi)(zi)(zi)價(jia)格上漲幅(fu)度大,假(jia)冒偽劣農(nong)資(zi)(zi)(zi)打著(zhu)廉價(jia)的(de)幌子趁機抬頭流入市場,損(sun)害(hai)了農(nong)民(min)的(de)利益。
2、宣傳教育缺位。表現在:一(yi)是對(dui)農資(zi)(zi)市場管理的重要性、必要性和對(dui)法(fa)律、法(fa)規宣(xuan)傳教育不(bu)(bu)到(dao)位;二是對(dui)假(jia)冒(mao)偽劣(lie)(lie)農資(zi)(zi)產品鑒(jian)別(bie)常識宣(xuan)傳不(bu)(bu)到(dao)位,一(yi)些農資(zi)(zi)經營者(zhe),特(te)別(bie)是許多(duo)農民缺(que)(que)乏(fa)識別(bie)假(jia)冒(mao)偽劣(lie)(lie)農資(zi)(zi)產品常識;三是缺(que)(que)乏(fa)對(dui)查禁的假(jia)冒(mao)偽劣(lie)(lie)農資(zi)(zi)商(shang)品公開處理的現場直(zhi)觀教育;四(si)是缺(que)(que)乏(fa)對(dui)查處的制假(jia)售(shou)假(jia)不(bu)(bu)法(fa)商(shang)販進行公開曝(pu)光。
3、農資市場管理體制不順,綜合執法力度不足,管理難度較大。農(nong)資(zi)市(shi)場管理是一(yi)項綜合(he)系統工程,既(ji)需要(yao)各級黨政(zheng)部(bu)門(men)齊抓共(gong)管,全社會廣泛參與,各職能部(bu)門(men)各司其職,各負其責,同(tong)時還(huan)要(yao)相互配合(he),通力合(he)作(zuo)。然而,該縣目前的(de)現(xian)狀(zhuang)是農(nong)業部(bu)門(men)沒(mei)有專職的(de)農(nong)業執法隊伍,各職能部(bu)門(men)之間缺乏(fa)有效(xiao)配合(he)與合(he)作(zuo),只從各自職責出發各自為(wei)戰,大(da)局意識不夠(gou)強(qiang),不能正確處理放手發展和(he)規范(fan)管理的(de)關系,極少(shao)數單位存在重收(shou)費,輕管理,輕服務的(de)現(xian)象。
4、農資經營主體不規范。一是無證(zheng)照經(jing)(jing)營(ying)(ying)(ying)(ying)(ying)。有些(xie)(xie)農資經(jing)(jing)營(ying)(ying)(ying)(ying)(ying)者(zhe)既不(bu)辦(ban)理(li)(li)《農資經(jing)(jing)營(ying)(ying)(ying)(ying)(ying)許(xu)可(ke)證(zheng)》,又不(bu)辦(ban)理(li)(li)《營(ying)(ying)(ying)(ying)(ying)業(ye)執(zhi)照》。二是超范圍經(jing)(jing)營(ying)(ying)(ying)(ying)(ying)。有些(xie)(xie)經(jing)(jing)營(ying)(ying)(ying)(ying)(ying)者(zhe)只有《農藥經(jing)(jing)營(ying)(ying)(ying)(ying)(ying)許(xu)可(ke)證(zheng)》卻(que)從事種(zhong)子(zi)經(jing)(jing)營(ying)(ying)(ying)(ying)(ying),還(huan)有的(de)擅自改(gai)變經(jing)(jing)營(ying)(ying)(ying)(ying)(ying)方(fang)式,將零售(shou)擴(kuo)大到批(pi)零兼營(ying)(ying)(ying)(ying)(ying),或(huo)搞(gao)起總代(dai)理(li)(li)、總經(jing)(jing)銷(xiao)等(deng)。三是經(jing)(jing)營(ying)(ying)(ying)(ying)(ying)者(zhe)不(bu)具備經(jing)(jing)營(ying)(ying)(ying)(ying)(ying)條件。一些(xie)(xie)經(jing)(jing)營(ying)(ying)(ying)(ying)(ying)者(zhe)不(bu)具備專業(ye)知識,或(huo)者(zhe)不(bu)具備種(zhong)子(zi)保(bao)管場所(suo),卻(que)照樣開起了“種(zhong)子(zi)店(dian)”。四是掛靠經(jing)(jing)營(ying)(ying)(ying)(ying)(ying),一些(xie)(xie)沒有取(qu)得《農資經(jing)(jing)營(ying)(ying)(ying)(ying)(ying)許(xu)可(ke)證(zheng)》的(de)個體戶,卻(que)掛靠在種(zhong)子(zi)公(gong)司、農技站等(deng)名(ming)下,在無委托(tuo)協議的(de)情(qing)況下成立(li)“分店(dian)”經(jing)(jing)營(ying)(ying)(ying)(ying)(ying)農資。
5、價格上漲幅度大,隨意性較強。去(qu)年(nian)(nian)以來,隨(sui)著市場的(de)(de)(de)變化(hua)全我縣農(nong)(nong)(nong)(nong)(nong)資價(jia)格(ge)漲(zhang)(zhang)勢加劇,大(da)(da)部分農(nong)(nong)(nong)(nong)(nong)資產品(pin)均(jun)以兩(liang)位數上(shang)(shang)漲(zhang)(zhang),化(hua)肥(fei)(fei)(fei)的(de)(de)(de)平均(jun)漲(zhang)(zhang)幅(fu)超(chao)過40%,一些品(pin)種達60%以上(shang)(shang)。如尿素較(jiao)(jiao)上(shang)(shang)年(nian)(nian)同(tong)期(qi)的(de)(de)(de)85元(yuan)增(zeng)(zeng)長12%。碳銨(an)(an)較(jiao)(jiao)上(shang)(shang)年(nian)(nian)同(tong)期(qi)的(de)(de)(de)25元(yuan)增(zeng)(zeng)長30%。磷(lin)肥(fei)(fei)(fei)較(jiao)(jiao)上(shang)(shang)年(nian)(nian)同(tong)期(qi)的(de)(de)(de)23元(yuan)增(zeng)(zeng)長45%。磷(lin)酸二銨(an)(an)較(jiao)(jiao)上(shang)(shang)年(nian)(nian)同(tong)期(qi)的(de)(de)(de)155元(yuan)增(zeng)(zeng)長50%。鉀肥(fei)(fei)(fei)較(jiao)(jiao)上(shang)(shang)年(nian)(nian)同(tong)期(qi)的(de)(de)(de)155元(yuan)增(zeng)(zeng)長60%以上(shang)(shang)。復合肥(fei)(fei)(fei)(45%)較(jiao)(jiao)上(shang)(shang)年(nian)(nian)同(tong)期(qi)的(de)(de)(de)110元(yuan)漲(zhang)(zhang)幅(fu)超(chao)過了(le)(le)40%等。農(nong)(nong)(nong)(nong)(nong)資價(jia)格(ge)大(da)(da)幅(fu)上(shang)(shang)漲(zhang)(zhang)“吃”光(guang)了(le)(le)國家對農(nong)(nong)(nong)(nong)(nong)民(min)(min)的(de)(de)(de)直補,挫(cuo)傷(shang)了(le)(le)農(nong)(nong)(nong)(nong)(nong)民(min)(min)種糧的(de)(de)(de)積極性,制約了(le)(le)農(nong)(nong)(nong)(nong)(nong)民(min)(min)的(de)(de)(de)購買力,因此農(nong)(nong)(nong)(nong)(nong)資經營(ying)戶(hu)今(jin)年(nian)(nian)普遍生意不景氣,化(hua)肥(fei)(fei)(fei)銷量比去(qu)年(nian)(nian)同(tong)期(qi)少(shao)了(le)(le)一半多。許多農(nong)(nong)(nong)(nong)(nong)民(min)(min)因復合肥(fei)(fei)(fei)價(jia)格(ge)的(de)(de)(de)高漲(zhang)(zhang),迫不得(de)已重(zhong)新(xin)選(xuan)擇(ze)單質肥(fei)(fei)(fei),甚至選(xuan)擇(ze)了(le)(le)價(jia)格(ge)低(di)下的(de)(de)(de)低(di)端化(hua)肥(fei)(fei)(fei),個別偏遠鄉(xiang)村(cun)甚至出現了(le)(le)白地下種的(de)(de)(de)現象。
三、相關建議
1、進一步提高認識,理順思路,加強管理。堅持“保障農民(min)利(li)益,促(cu)進發展(zhan)”的方針,堅持“懲教結合(he),以教為主”的管(guan)理辦法,強化管(guan)理促(cu)發展(zhan),達到管(guan)而不死,活而不亂,從(cong)而形成一個繁榮、健康有序的農資市場(chang)新格局(ju)。
2、進一步加強法律法規的學習和宣傳。加大宣傳教(jiao)育(yu)力(li)度(du),努力(li)增強(qiang)全民(min)法制觀念(nian),積極引導廣大群眾提(ti)高識(shi)別假冒偽劣農(nong)資的能力(li),并學(xue)會用(yong)法律武器(qi)保護自(zi)己的合法權益,教(jiao)育(yu)引導農(nong)民(min)采取措施(shi)積極應(ying)對農(nong)資漲價;同時督促教(jiao)育(yu)廣大農(nong)資經營戶要誠信守法經營。
3、強化制度建設,建立長效監管機制。首先是(shi)要(yao)健(jian)全責(ze)任(ren)追究制(zhi)度(du),對發生(sheng)重大(da)假(jia)冒偽劣(lie)(lie)農(nong)資案件,造成(cheng)農(nong)民嚴(yan)重損失和惡劣(lie)(lie)社會影響的(de)(de),有關(guan)部(bu)(bu)門要(yao)嚴(yan)格(ge)(ge)(ge)追究相關(guan)人員的(de)(de)責(ze)任(ren);其(qi)次是(shi)要(yao)完善投(tou)訴舉報制(zhi)度(du),建(jian)立健(jian)全投(tou)訴舉報處理機(ji)制(zhi),落實(shi)案件上報和督辦制(zhi)度(du);三(san)是(shi)要(yao)加(jia)強協同配合(he),工(gong)商部(bu)(bu)門要(yao)在規范農(nong)資市場準(zhun)入的(de)(de)同時,堅決取締和打擊(ji)無證經營和各種(zhong)違法行為,質監部(bu)(bu)門要(yao)嚴(yan)把生(sheng)產(chan)和流(liu)通環(huan)節農(nong)資產(chan)品質量,杜(du)絕假(jia)冒偽劣(lie)(lie)農(nong)資流(liu)入市場;物(wu)價(jia)部(bu)(bu)門要(yao)加(jia)強農(nong)資價(jia)格(ge)(ge)(ge)的(de)(de)監督檢查(cha),嚴(yan)厲打擊(ji)哄抬價(jia)格(ge)(ge)(ge)、牟取暴(bao)利等價(jia)格(ge)(ge)(ge)違法行為,確保農(nong)資價(jia)格(ge)(ge)(ge)穩定。
4、進一步加強市場監管,規范農資經營秩序。一是要認(ren)真執行(xing)農(nong)(nong)資(zi)經(jing)營(ying)(ying)市(shi)場準入(ru)(ru)制(zhi)度,嚴把市(shi)場準入(ru)(ru)關(guan)。農(nong)(nong)業(ye)部門(men)切(qie)實做好全(quan)縣農(nong)(nong)資(zi)經(jing)營(ying)(ying)網點的布設、經(jing)營(ying)(ying)資(zi)格的認(ren)證、審定(ding)、登記、注冊工(gong)作(zuo),工(gong)商部門(men)對已(yi)經(jing)發放《營(ying)(ying)業(ye)執照》的單位和個人要進(jin)(jin)行(xing)一次全(quan)面的清理和核查,對不(bu)符合許(xu)可、登記條件的或者有違(wei)(wei)法經(jing)營(ying)(ying)行(xing)為的按有關(guan)規(gui)定(ding)注銷(xiao)其經(jing)營(ying)(ying)資(zi)格。二(er)是要進(jin)(jin)一步強化農(nong)(nong)資(zi)市(shi)場的整治工(gong)作(zuo)。要突出化肥、農(nong)(nong)藥、種子等(deng)重點產品,嚴厲(li)查處假(jia)冒偽劣產品,堅決打(da)擊坑農(nong)(nong)、害農(nong)(nong)的不(bu)法行(xing)為,鏟除制(zhi)造、加(jia)工(gong)、銷(xiao)售窩點,并對已(yi)查處的重大農(nong)(nong)資(zi)產品違(wei)(wei)法案件進(jin)(jin)行(xing)曝光。
5、構建連鎖網絡銷售模式,建立健全規范的市場秩序。積極培育龍頭企業,加快(kuai)構建(jian)以連(lian)鎖配送為(wei)主導(dao)的(de)農(nong)資(zi)銷(xiao)售網絡,連(lian)村到戶,提升農(nong)資(zi)經(jing)營企業的(de)市(shi)場競爭(zheng)力。一方面(mian)對(dui)產(chan)品質(zhi)量好(hao),經(jing)營機構規(gui)范農(nong)資(zi)企業要(yao)積極爭(zheng)取在政(zheng)策(ce)、資(zi)金等方面(mian)給予(yu)支持。另一方面(mian),要(yao)積極與縣外化肥生產(chan)企業聯(lian)系(xi),發展(zhan)聯(lian)儲、聯(lian)銷(xiao)、總(zong)代理、總(zong)經(jing)銷(xiao)等多(duo)種工商合作模式,從源頭上保證農(nong)資(zi)產(chan)品的(de)質(zhi)量,切實(shi)規(gui)范農(nong)資(zi)市(shi)場秩序。
